EVEREST GREENZ TERMS & CONDITIONS

Please read our Terms and Conditions carefully. If you do not agree with the terms of this privacy policy, please do not access the site.

We reserve the right to make changes to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of this form. Any changes or modifications will be effective immediately upon posting the updated Terms and Conditions on the Site, and you waive the right to receive specific notice of each such change or modification.

You are encouraged to periodically review these Terms and Conditions to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Terms and Conditions by your continued use of the Site after the date such revised Terms and Conditions is posted.

GENERAL TERMS

Purchase Terms

This agreement is made between Everest Greenz (Contractor) and You (Client).

Everest Greenz agrees to furnish labor and materials and is authorized by you to treat the property at the address submitted. You represent and warrant to Everest Greenz that the person accepting this agreement has the authority to grant Everest Greenz the right to treat the property in accordance with this agreement. The procedures used will be determined solely by Everest Greenz.

Client agrees to notify Everest Greenz in writing in the event that there is a change in ownership for the property which is the subject of this agreement. Client may choose to transfer subscription to new owner for the same property if desired.

Service Term

Full season Landscape Maintenance subscription duration is April 1 through October 31 annually.
Full season Winter Maintenance subscription duration is November 1 through March 31 annually.
For mid-season starts, your initial subscription term will begin upon initial payment.
Subscription start date does not reflect service start date. You will receive your service schedule separately following initial payment. See “Service Quantities & Frequencies” below for more details.
Auto-Renewal: For business planning and continuity the selected Landscape Maintenance and Winter
Maintenance Contracts will automatically renew for another full term on the end date of their current term respectively. For non-renewal by either party, notification in writing is required at least 30 days prior to this renewal date. Requested upgrades/downgrades to selected packages should also be submitted 30 days prior to contract renewal. The terms and conditions of this agreement shall remain in full force and effect during any renewal period

Service Quantities & Frequencies

Mowing services are weekly unless otherwise specified in a custom quote.
Everest Greenz will begin scheduling services upon receipt of initial payment. Service dates will be automatically sent via email upon scheduling.

Initial mowing service is subject to a delay of up to 7 days from time of initial payment to allow for proper scheduling.

In order to prevent damage to turf from over mowing during shoulder months, your service quantity will be reduced by half in April & October. Your total subscription price already reflects these reduced quantities.
Services are subject to delay due to weather & holidays. In the event that services are delayed for any reason, you will receive a scheduling modification notification via email.

Recurring services that do not take place for reasons outside of Everest Greenz' control (weather, customer request to skip, access issues, etc) will not be refunded. Your total contract price includes 5 free ‘buffer visits’ to account for the possibility of these issues

A trip charge of $25 will be applied for requested return trips if the crew cannot access all service areas (e.g. – locked gates). Return trip availability is not guaranteed.

Snow removal services will commence within 6 hours after snowfall ends between the hours of 4am – 8pm local time or once per day during continuous snowfall that spans multiple days.

PAYMENTS

Landscape Maintenance:

Total subscription amount will be paid in equal monthly installments or one installment if Prepayment is selected.

Monthly Billing: First & last month installments are due immediately to reserve your spot on the route. The first & last month installments are non-refundable. The remaining installments will be automatically processed monthly and are prepaid for the upcoming month.

Prepayment (Annual) Billing: Total subscription amount is due immediately to reserve your spot on the route and access your 5% discount. Prepayment subscriptions are non-refundable but may be transferred in case of a change of ownership.

Overgrowth Surcharges:

When you request lawn care services, it’s crucial to assess your lawn’s current length accurately. Everest Greenz categorizes lawns with grass height exceeding 6 inches as ‘overgrown.’

Situations of overgrown lawns are not unusual in the landscape services sector. Typically, overgrowth is caused by newly acquired properties, deserted premises, neglectful tenants, or just being too preoccupied with life’s demands to tend to the yard. All of these scenarios are understandable, and we’re here to assist!
When you ask for our services, we estimate a standard measure of your grass length assuming it is under 6″ unless otherwise noted by our customer. By submitting your order, you implicitly agree to any applicable overgrown charges necessary for properly servicing your lawn and reducing it to a manageable size. Be assured we’ll always provide photographic proof to substantiate any overgrown charges.

Overgrown Lawn Pricing Tiers:

Grass 6″-12″ tall, the revised rate will be +50% of the standard cutting cost. For instance, if the normal cut costs $30, the adjusted price will be $45.
Grass 12″-24″ tall, the revised rate will be +100% of the standard cutting cost. In this case, a $30 cut would increase to $60.
Grass 24″ or taller will require a custom quote for handling your unruly lawn, enabling smooth future services.

Winter Maintenance

Total subscription amount will be paid in equal monthly installments or one installment if Prepayment is selected.

General Payment Terms:

Availability is on a first-come, first-serve basis. Your spot is not confirmed until the initial installments are paid in full.

Client authorizes Contractor to automatically process the provided payment method based on the payment schedule.

For failed payments a 2% per month late fee will apply.

All services provided under this contract may be suspended at the sole discretion of Everest Greenz when a payment is past due. During time of such suspension, if any, Everest Greenz is not liable for any costs or damages that may arise from, or are related to, a suspension of services.

Should it become necessary to bring any action to collect amounts due under this agreement, you agree to pay all costs of such collection, including reasonable attorney’s fees, court costs, or the costs of arbitration, including reasonable attorney’s fees.

Inflation Adjustment: The winter and summer season prices provided in this contract shall be increased each season upon renewal by a percentage equal to the percentage change in the Consumer Price Index statistics over the previous 12 months at time of renewal as published by the Bureau of Labor Statistics at www.bls.gov. In no event shall this calculation cause a reduction in the season price below that payable during the preceding year.

Contractor reserves the right to increase renewal pricing for reasons beyond the inflation adjustment previously outlined. Written notice of such increase shall be provided to Client at least 45 days before the renewal date.

Damages

Everest Greenz shall not be responsible for any damage to owner’s property caused by events outside the control of Everest Greenz, including damage resulting from vandalism, natural causes, acts of God, drought, or unusually dry or wet weather. Everest Greenz shall also not be responsible for damage to sub-surface lines that would include but are not limited to invisible dog fences, cable TV, security lines, irrigation and lighting systems, gas barbecue and pool equipment lines, or items buried under snow.

It is understood that all de-icers and sand salt mix may cause damage to landscape, concrete, and paved surfaces. Although the Contractor will be prudent in its use of these materials, it is the Contractors intent to provide as safe an environment as possible, and therefore will not be responsible for damages these products may cause.

Should Everest Greenz cause direct damage to property outside of excluded items listed above, by providing the services described herein, Everest Greenz will either replace or repair damaged item or provide you with the reasonable replacement costs. Client must provide written documentation of any damage within 7 days of damage occurring.

Everest Greenz, however, is not responsible, under any circumstances, for incidental damages, consequential damages, special damages, expectation damages, punitive damages, or exemplary damages. The parties further agree that Everest Greenz will not be held liable—in any way whatsoever—for performing the services contemplated by this contract, including, but not limited to, any civil or criminal claims against Everest Greenz, its managers, executives or agents.

Both parties acknowledge that snow and ice create hazardous conditions. The Client will hold harmless from Contractor and its employees all claims and liabilities which may arise as a result of snow, ice, sand, gravel, slush, snow melt, or ice melt.

Termination

This contract may be canceled immediately by either party upon written notice. Email notice is acceptable.
